FREEDOM OF OPINION SHOULD BE SECURED BY THE JUDICIARY

The detention of the members of the Turkish Medical Association central council, following the investigation initiated by the judicial authorities,cannot be the act of a state that claims itself to be a state governed by the rule of law.

 As Istanbul Bar Association, we define the ongoing military intervention in Afrin as a legitimate intervention against the terrorist organization threatening our border security and its patron, the USA Imperialism.

However, we are well-aware that it would be not be in line with the belief of democracy to expect anyone to hold the same opinion. Shifting the ground for the differences of opinion from the discussion/debate arena to the judicial arena would severely harm democracy.

It is totally unacceptable that the judicial authorities start legal proceedings and make arrests that are becoming increasingly threatening , as they position themselves next to the political power in any discussion arising in politics, On the contrary, the judiciary should secure the freedom of opinion.

As a legal institution, we deem  it necessary to put an emphasis on the fact that the statement of the Turkish Medical Association does not constitute a crime and, within this scope, a statement expressing an opinion that does not have any content that could be criminalized cannot be the subject of any search/detention.

We hope that the above-mentioned legal proceedings would come to an end without the need to be prosecuted.
